As long as:

A) You don't regularly return items at Walmart without a receipt

And

smilie You aren't trying to get cash

They will likely not give it a thought and just let you exchange it.

I believe you can exchange it at Gamestop.

Tell them the whole truth and they will likely exchange it.

As a back up plan you can sell it on ebay for retail price and buy the right version

You could just sell the system you don't want on Craigslist (an adult has to do this), and then use the cash from that sale towards buying the system that you do want.

Most stores shouldn't have an issue with an even trade. Some people on here just want to cause problems and make up stuff they have no idea about. Granted, stores usually want a gift receipt (if they have them), but are willing to make an exchange even if you don't have them. They understand that sometimes people lose the receipts when they give them as gifts. If you went into a store and said you got it as a gift, but they got you the wrong one and asked to exchange it for a similar item, there should be no issue and you wouldn't be lying. If you wanted to take it back to the store they got it from, then I understand. I would, too, unless there was an issue. You really think that those long return lines at Walmart (and probably other stores) the day after Christmas is full of nothing but people who have their receipts? Most (if not almost all) of them are probably returning items they got as a gift and didn't have a receipt. If it was fraud or illegal, then the stores would never allow it. Some will abuse the system, for sure, and that is why they take your information to track how many returns people are making. There may be some ethical issues if you picked up something from one store and traded it at another, but that doesn't mean it's illegal. Now that you know that it is from Gamestop, though, you can always try and take it in there and see. You are trading it for the same item, just a different system, so they may allow it. If they won't, then see if your friend used a card of some sort (debit, credit, etc.) and they may be able to look it up. If that fails, then you have no choice than to exchange it somewhere else or try and sell it.

Dude, just go to Walmart and exchange it, seriously. As long as you don't regularly return items without a receipt they are going to call a manager up to approve it (cause it is over $50) and they might not even do that. The worst thing that can happen is that they deny the exchange.

If they don't have the Wii version in-stock, as if you can return it for a gift card and try to find it at another Walmart. Heck, have the service desk people call nearby stores for you.

A.) Yes, it is illegal. It's the very definition of return fraud. Just because you probably won't get caught or they probably won't prosecute doesn't mean it's not illegal.
B.) As already discussed, Walmart currently carries a different SKU for SWAP Force. Walmart versions have a blurb to the left of Stealth Elf about the included coupons and have a different barcode on them.

Walmart also carries the standard packaged bundles

Past that, being someone who is closely familiar with Walmart return policies and what happens when someone is caught fraudulently returning something, I can tell you that simply trying to return an item without a receipt barely constitutes refund fraud - especially at Walmart (Unless for some reason they are on the lookout for that specific item or yourself).

The only reason they will question it is if they think you are trying to return something you just plucked off the shelf. If you enter the building with the item in question they only have two decisions to choose from - Yes (return or exchange the item) or No (Denied).

Interesting - I've never seen the non-exclusive bundles in a Walmart.

Returning an item without a receipt is not return fraud.

"Returning" an item that was not purchased at that retailer *is* return fraud. Seriously, you can't "return" something that was never there to begin with. Sure, they'll probably do it. Sure, you likely won't get caught. But that doesn't mean it isn't illegal. Period.

And I'm willing to bet I'm probably more familiar with Walmart return policies than you are. smilie

Obviously if UncleBob hasn't seen it, it must not exist.

A store that allows you to return items without valid proof of purchase isn't very worried about the origin of said items.

Lastly, I don't give a fecal spore how familiar you are with Walmart return policy. Keep your condescending smileys to yourself UncleBob.

UncleBob is correct though. If you KNOWINGLY return an item to a store it wasn't purchased from, that is fraudulent. ((i.e. buying from a Target store and returning to a TRU, not buying at Target #55 and returning to Target #201.))

And to the OP, seriously, just go to Gamestop and ask about returning the game or exchanging it. People give the wrong versions of games as gifts all the time. If they have to have a receipt they'll probably ask for the buyer's phone number (rewards account), but I honestly just think they'd do an even exchange. You're making it into a much bigger deal than it needs to be.

Go to GameStop WITH your friend, he can answer any questions, tell them how he messed up, etc. etc.... Plus with his help, you can go to the actual location he bought it at, which might help (like an employee recognizing him or something), make things go smoother. As we've been saying, with all the consoles out there - something which has been around for decades - buying a gift for the wrong system is NOTHING new.

Is this thread resolved yet?

The solution is easy. Go to Walmart and do a return. Just tell them you can't find the receipt. They won't hesitate to give you a full return. They won't ask you any questions. They will just give you a gift card for the full amount. Use it to buy the Wii version.

Don't listen to the Internet police here. There is zero risk and it is not illegal. Walmart willingly has this no receipt return policy. They know what they are doing.

But it is illegal. I wouldn't suggest giving out legal advice when you don't know what you're talking about.

No, you are clearly wrong here. It is very much illegal. As mush as I am loathe to use Wikipedia as a reference, it is just the easiest place to source:

http://en.wikipedia.org/wiki/Return_fraud

Quote:
Cross-retailer return: Returning or exchanging an item purchased at another retailer (usually at a lower price) for cash or a similar, higher-priced item at another retailer.

No, they usually won't give you a problem over it, but it is what it is. Stop denying that. The law is clear on this. Walmart purchases games for sale from distributors, not customers. They are not a swap shop. You are taking advantage of their return policy which is how it is in order to serve their business and satisfy customers. Abuse of return policies is the reason restrictions get added all the time, which ruins things for everyone.

Not to mention, by guaranteeing someone they will not have any problems, you are probably correct. The employees usually don't care enough to worry about it, or are eager to not get into an argument with a customer so they just do it. But, there IS a chance you will get that one manager in a bad mood, or just did inventory and a copy of Skylanders Swap Force had been stolen and will decide to make an example of you. Or maybe he decides you need to tell him exactly when you bought it so he can look it up. Then you are hosed. Low risk, but there is risk. Take it at your own peril.

Either get the receipt from your friend, have him go to the store he bought it at with you so he can explain, or trade it in used and use the credit to buy the other one. Otherwise you are rolling the dice, and breaking the law. Someone has to win the "lottery".

I really don't know why you seem to be trying to do this without your friend... Go WITH him, to the store where he got it. Since he got it wrong I'm sure he'd be willing to help you fix the error...

And yeah, they're being jerks. If it's still sealed they have no right to complain: "Why, do you sell packs with broken portals or toys?". It's unfortunate your friend doesn't have the receipt or you could force the issue, speak to a manager, etc. Without a receipt you need their help, so you need to be nice and hope they'll be nice back.

As a Gamestop employee, I can tell you that if you said you wanted to trade it in, we're automatically going to think you want to trade it in like any other game... You need to say you want an exchange on the item, not a trade in. ;) Trade in would give you less money than what its worth because it would be technically considered used. We used to take used Skylanders, but not anymore. Not sure what happened there. Go back maybe with, I don't know, your friend who bought it! and tell them you want an exchange for the Wii version. Hopefully you didn't open yours already.

As far as I am aware, we will not take just the disc, especially with Swap Force. If a customer were to come in to buy the game, they would need the new portal as well, and as we all know, there is no portal owners pack this time around, nor is the portal sold separately. It wouldn't be in GameStop's, or the customer who comes in looking for the game for their kid's, best interest to only sell the game.

Our policy on returning Skylanders is usually, we don't. Like I said in my previous post, we used to take in used Skylanders figures, but not anymore.

If the game has never ever ever been opened: the seal is still in tact and everything-- there should be no problem exchanging it out for the correct version, but then again, every GameStop employee is different, and your store may have had issues with exchanging Skylanders games in the past. Try another GameStop in your area and see what they say. Our Holiday Exchange/Return policy has just gone into effect, so right now there is a bit of confusion. We also just did a bunch of hiring, so you may be talking to Holiday Staff who are still learning the ropes.

If going to a different GameStop does not prove well in your favor, give our customer service number a call. See what they say about it. Someone higher on the food-chain so to speak will definitely know more about it then your average game adviser.

Yeah, I say go back, DO NOT open it, you're screwed then. DO NOT call it a trade or an exchange, this is a RETURN. I'm convinced that they think this is a second-hand item you're trying to sell back, and I saw ages ago that they don't accept Skylanders (I expect it's because the Skylanders save data, and getting one which isn't Level 1, 0 XP, 0 gold feels VERY used. Also that you might be returning it because it's broken, it doesn't work, meaning they can't resell it). They have the option to refuse to buy something used. They DON'T have the option (or they have less of an option, since there's no receipt) to refuse a return, especially an unopened return. ALL your power is in the fact that the thing isn't opened. If you positively, absolutely, no way no how can return it, selling it will have FAR greater value if it's still sealed anyway. So under no circumstances whatsoever should you open it.

Make it clear that this was PURCHASED there and is being returned because it's the wrong item, and you would like to have the right item. Don't say "exchange", say it like that, it sounds like they're easily confused. And again, as long as it's sealed, they have no grounds to whine about "We don't know if it works". If they try, just ask if they're in the habit of selling broken merchandise, because if this is broken, it was broken when it was sold, the package is still sealed.

I'm sorry, but I must absolutely disagree with NiceGuy on the linguistics of his post. From a company standpoint, I would much rather do an exchange, rather than a return. A return loses me money, while and exchange keeps the money I have already gained from the sale, but the product switches out. What he was is exactly that: an exchange. It doesn't make the employees feel like they're incompetent-- if anything we're more likely to sympathize with you because you didn't get the product you wanted, which means we failed at our job in ensuring your satisfaction, so we're going to try to make it right this time. In the OP's case, it wasn't the employees, or his fault that he got the wrong item. It was a gift.

Honestly, at this point, it may be best to just give the item back to your friend and let him and his folks worry about the headache of trying to exchange it out for you since they were the ones who originally bought it. Chances are they have a power up rewards card with GameStop, so we'll be able to pull up the transaction through that to prove that it was purchased at one of our locations.

If the game is unopened, there should be no fuss. I've seen other people post on here that their GameStop's allowed for them to return or exchange starter packs for different systems.

If speaking to the actual store manager doesn't work out in your favor, don't be afraid to ask for the district managers number. Our policy, unfortunately, changes all the time, and sometimes the command words take time to trickle down to the employees, so your store may be working off old information.

Lady Valdyme: Well, obviously the intended transaction is an exchange, just that it sounds like he used the word "exchange" and they still misunderstood, like they thought he wanted to sell something which was used, and he wanted to put it towards the purchase of something new. My suggestions are intended to make it CRYSTAL clear that this is a brand new product being brought back, or "un-sold" as it were. That it's unused and they have no reason to suspect anything doesn't work. So, I say call it a Return, and in the process say he wants the Wii version instead. (IN the process, not afterwards).

I agree with you, he should give it back to the friend to have them sort it out, it seems like they're in a better position to, seeing as they made the purchase in the first place. I however doubt these repeated declarations of "they probably have a power up rewards card". I don't see how this is probable. I've bought many things at EBGames - Gamestop in Canada - and I haven't signed up for one... Or rather I think I had one but after a year I found out it required a yearly membership fee so I let it lapse. Some adult gamers who buy regularly might find it worth it, but I'm sure many parents of gamers wouldn't, or wouldn't even think of getting it in the first place.
