A while back, there were what looked like figures in Walmart's ad. More recently, TRU had some in their ad that looked like figures as well.
Lemme see if I can find the images.
So far there's been nothing..so maybe they decided not to release them or what.

We know that TRU DID get in Legendary stretchies, BUT....that Trigger Happy is no way a stretchy. Look at the shine on his head. Only a hard plastic would give that sort of appearance. Same with the details on him. The Spyro however is a stretchy.

And there's the walmart one. Notice the Spyro and Gill Grunt have a plastic look to him. Also take note that the Stretchy Gill Grunt has a harpoon in his gun, while this one doesn't. There's also a "collectable" tag on the Spyro which doesn't occur in any other merchandise. (stretchies have a cardboard back on them and say "strectchable" on them..or something like that)
So...they had to have had figures at some point but they decided to not release them or something. Since this stock art stuff exists for them.
EDIT: now that I look at your picture, it looks like the Megabloks one.
