I noticed I can only equip it ON Nightmare mode. The others mode I can have it on FROM nightmare mode but I can't EQUIP it on any other moder? Thoughts?

Doesn't it only unlock in nm mode? No other file would have it unlocked.

Yes, you can carry hats over to other save files. I use my knights helm on my DT, and in both files it is on him. Heck, even in my cousins wii giants it is still on him.

Well, hats are stored in the game file and not on the toy figurines. So of course you couldn't equip it outside Nightmare mode (considering how you have to beat it to get it, and you can't switch to the other modes in the same nightmare file).

At least you can have it FROM since you can keep wearing it on the figure unless you switch to another hat or take it off. For example, if you take your Sunbutt or Trashwing (funny insult nicknames) to a friend's house wearing the helm, they'll still wear it.

Just like my wreckingball still has the ssa 3ds balloon animal hat. Never taking it off.

Yup, you can only fill your chart up on Nightmare. But it's not about the chart; it's about wearing the game's best hat bar-none on all your characters. That last spot on the hat collection tab bugs me for OCD reasons as well, but I unlocked it because it was good (TOO good), and not to fill the unfillable E/N/H Mode collection.
