Many people sell singles of the starter pack figures on ebay and craig's list, i would start there!

Maybe you're not searching it the best..? I just did a search and those are not the prices i'm seeing, most seem to be in the $15-20 range... this one ends in a day (0 bids at 9.99) or you can "buy it now" for $18 http://www.ebay.com/itm/Red-Tr...=item35c251fcb2

Why would he do that? Would he mistake Tree Rex for some kind of trash?

You could try contacting Activision to send a replacement, but I don't know if their warranty covers lost figures.

He could try and do that, however they are going to ask for a picture with a case number to confirm that he has it. They would want Tree Rex and on a piece of paper showing that number they gave him. Would be hard. It's too bad that people scammed them, that they have to do that now.
