Still, it's the fact the guy has them inhand as we speak. Even if he doesn't sell them until after street date, it still means employees or those who know employees are finding ways to get them early. Once this catches on, who's to stop other employees from doing the same thing?

This is where I hope Activision is telling the truth, in that they will have plenty of stock and never run out.

If it's an employee he/she must have stole them. Walmart's computers don't even allow sales to process if the item has a street date. Also, the big retailers all send sales data to their vendors and none of them would allow early sales because they would show up as street date violations on the daily numbers reports to the vendor.

I bet this guy is from Walmart, since SOME are known to be semi-suspicious (No offense to those who are on this site and work there.).

The person in question may also be making an overt effort not to post any exclusives til after launch as not to give away their retailer and effectively hide better.

Anytime I see this stuff, I keep showing it to a member of TFB in hopes they go to Ebay to find out who the seller is and do what it takes to get onto them.

Looks like there is another seller on eBay as well, I think it may be the same guy-different username. Ships out 22nd, pic with hand written tag.....hmmmmmm. Right now, just has swarm listed.

the person could go to jail for this the reasons why is #1 the rights of game companys say that you will be charged for making extra profit off of the product before its avalible#2 its illegal to sell or advertise in hand before realease of the product #3 stealing the product from the company or store before release/ stealing in general is against the law.

I guess so... no one's gonna do anything about it though.

Anytime something like this happens on Ebay, when it comes to early release Skylanders, I make sure to let the senior designer know.

He responded to me a little bit ago, when I showed him this link. What did he say? "I suppose it's time to send the hounds." Yep, someone's in trouble.

I don't see how they could get in trouble. It's for a pre-sale. Maybe have the listings removed from eBay, but he could list pre-sales without the actual picture and it would be okay, so I don't know.

They are smart to not ship until after the release but that also makes it highly unlikely anyone would shell out a 500% markup for something that will be at all the stores day before the seller will be shipping.

They have them inhand. Even if it's a preorder, he has the physical items early. They're keeping said item from being on shelves when they're supposed to be, which makes Activision look bad. It's wrong, and that's why he said what he said. I also sent him a link to another seller who is selling all of wave 1 and has them inhand.

See, with two weeks to go, what's to stop any employee from doing that? The more it happens, the less stores will have on day 1, which means backlash from parents who will lose faith in the property and its ability to keep shelves filled with the characters to play said property.

I'm surprised you're all shocked this is already happening. Of course it was going to. The game is a huge commercial success now and stores would practically have to receive the figures early to get the promised, well, more like supposed, extra stock.

Holy Christ, some of you know so little about the law and such.

A) No one is going to "jail". It's not a criminal offense to sell product before a "street date".
One *could* face fines if they signed a contract (in this case, with Activision) stating that they would uphold Activision's street date.
C) It's very unlikely this seller has signed any such agreements.
D) The fact that they don't ship out until after the street date would negate *any* of that anyway. These would be presells, no different than GameStop taking my $25 for the Cannon battlepack.
E) There's no proof this guy/gal "stole" them from some store's backroom. He/She could have easily TAKEN THE PHOTOS from the backroom via a cell phone. Then, whatever sells via eBay, he/she can just buy release day and ship out that Monday.
F) Not all retailers send sales data back to the vendor. Very few do it on anything more than a weekly basis.
G) I seriously doubt this is a store employee. It would be very unlikely that any store has cases upon cases of these sitting in the back room for two weeks plus. Backroom space is very precious for every major retailer. These probably won't arrive in stores until the 12th at the earliest. And don't give me that "Well, I heard..." Did you, personally, actually see the cases of figures?
H) Better chance that these came from a warehouse or distribution center (possibly for a dot-com retailer).
I) Stop being cry babies at the "scalpers". It's really quite pathetic. We're talking about little plastic toys - not bread or water. If you have to wait an extra month to get one, your life isn't so pathetic that it'll come crashing down around you.

Does anybody else here think that if someone is willing to pay $59.99 for a pre order, then THEY are the bigger problem?

This is just ridiculous. Why would an employee take figures from stock and put them 5 times their price for a PRE-ORDER on Ebay!?

Don't worry. No one's gonna be dumb enough to buy this crap if they wait another 3 weeks.
