I suppose what it really comes down to is how you are about the above. Are you someone who believes that the punishment for the crime should be equal to the crime itself? Or do you believe that doing such is stooping to their level, and isn't the moral, ethical, or even mature thing to do? I tend to fluctuate between the two ideals so I don't know myself. Regardless of where I stand, what I do know for certain is that if the death penalty is to continue, it should be lethal injection. The electric chair is messy and terrifying, and hangings/firing squads (especially in public) are simply inhumane by today's standards. |

I'm all for the death penalty. If a killers only language is violence, you have to speak to them in their native tongue. It's currently only used in the US for first degree murders where there's conclusive DNA evidence and/or a confession that matches forensic details. Mental health, age of the defendant and previous criminal record are also taken into account. In other countries such as China, the death penalty goes beyond first degree murder to include drug trafficking. There are statements in the US code that could potentially include the use of the death sentence for drug traffickers, but it's almost never used.
Since almost all "convicted" murderers are on death row for years, there's plenty of time for appeals where the case is examined again by an appellate court which takes into consideration some details that may have been missed or weren't included, bias, false evidence and abuse of power. Some death row inmates can lodge several of these which further strengthens or weakens the defendants connection to the crime. The current system has many fail-safe procedures that ensure the right person is convicted. A source of parts of my information can be found here. I do however think the method of execution needs to be changed to one with a reliable and abundant source that can readily be obtained by the executioner. Which method? I currently don't know. |

Does it really matter? It's such a rare instance in this country anyway. It's made worse by the fact that our judicial system really draws out the appeals process. Someone can be on death row for decades before the execution date is even set, since the lawyers can continue to make appeals to higher level courts. Ultimately, the Supreme Court will never end up hearing criminal cases like these, but that doesn't make the whole system any less quick. If they need to figure out ways to reform the death penalty, what they really need to start with is our justice system. But that's a "State's rights issue," so I doubt anything will actually be done.
