I just got a email on a preorder Quick Draw, from the seller, stating that Frito Lay said they ran out of Quickdraw and are replacing him with the regular rattle shake. Has anyone else received this so called email? I dont believe him.

Hmm... First I have heard of this, but it wouldn't surprise me. I would be suspicious of that email, considering the source, but it also wouldn't surprise be if Frito Lay ran out of Quick Draw, considering the way they ran the contest.

I wouldn't be suprised if it was true. This contest was badly done allowing people to win dozens ofvthem.

I haven't had that happen. I'd call toll free number and ask before I'd believe that. Sounds like someone trying to get out of a "sold to many" situation. But I guess you never know

I guess anything is possible and the contest was a friggin bust. I think he got more from it from someone else and canceled me. I had my money refunded, but the point is, I didnt bother bidding or watching for 7 weeks because I thought I had one coming.

Regardless of whether or not Frito-Lay is no longer sending out Quickdraw Rattle Shake doesn't excuse the fact that the seller is shady and should be reported as such. Here's eBay's policy on presale items and I doubt that he met any of their criteria. He wasted your time, got your hopes up, and sat on your money for the past however many days.

I seriously doubt that they "ran out". The contest was set to give one every 15 minutes for a set amount of days. They knew the exact number they were going to give out.

Here's the email I just sent him:
When did you get this email? This has been a huge waste of my time. I'm having a hard time believing you about this email. I think you sold it for more then what I bought it for. I have over 15 responses to the question of the aforementioned and no one has heard of or received a email, like, that your claiming. Good luck with your next sale.

As I can tell you that would not be the case for quickdraws to be replaced. I know for a fact the rounds they made for shipping the figures has gone for before xmas, january 2nd and the 12th for many of those who have won and I had several arrive that were shipped on the 12th already and they are quickdraws.

He had probably 3 but put auction up for more than he had then only shipped the highest paid out and then refunded the lowest ones back there money has happened to me on another item I purchased seller said they had 5 sold them then only shipped our to the highest price and refunded my money saying item got broke.

There's no scam going on if the seller refunded his money. It can be annoying to the buyer sure, but it isn't a scam.

#21 Posted: 22:47:14 19/01/2014
It is a scam if you list something sell it then don't ship the item and just refund the buyer. The scam is the fraud of not following through on the commitment. In this case told the buyer a flat out lie that Frito lay ran out of quickdraws and was shipping regular rattleshakes, I know that for a lie since I have called and actually ask this question, they said no that they had enough to fill every winners spot and that if they could not then they would be prone to lawsuit since they advertised 1 every 15 minutes of the contest so they did in fact fill every winners spot with a Quickdraw.

Just because money is reimbursed dpesnt make it ---ok. It was still misleading and eventually dishonest. Defining a "scam" may be different for different people. For me--the example given above---feels like a scam.

It sure is a scam if its a dishonest deal that has to do with money. Its not ok to do what he did, but im sure you know all that and just wanted to show another point.

I haven't read all the responses in this thread, but just in case others haven't made this clear to you: you are being scammed by that eBay seller.

This is reason #789659 that no one should *EVER* do a "pre-sale" via eBay. There probably are a handful of honest reputable "pre-sale" vendors on eBay, but a huge chunk of them are scammers, and they will prey on the consumer's naivety and anxiety.

Stay away from "pre-sales". Far away. Always.

I'm sorry you got bamboozled, as you probably have already surmised, don't pre order stuff on Ebay, they usually don't have the item to begin with and it's all based on if they even get the item, that's why so many people get hurt around Christmas time because scalpels are desperate to get those XBox ones PS4s and new Skylanders to meet their pre orders. If you still don't have a figure I'm pretty sure someone here in the forum could hook you up through a... I don't think I can say the "T" word but it's done through private messages... smilie

He has 100% feedback and I believe I've purchased from him before. I remember having to correct him on some information when he was sending a card for a different Gnarly than my figure (he wasn't keeping them together back when you could only get them in the Wii package).

So, in my mind he's probably shooting from the hip...but I doubt he was being dubious. Still, preorders are generally a bad idea, guys.

^ If one is going to want to buy a figure from a seller on eBay, it's best to wait until they have it in-hand.

I have purchased many pre orders from a couple of sellers that I have had 100% success with and I only purchase pre orders from them.Once you get a seller you can trust I save them as fav sellers.I look at there feedback and see how many successful pre order comments there is.

I had preordered a few Giants figures before they came out, and I got ratted out of a deal. The seller never shipped them, and I was forced to go through eBay to have the seller removed from eBay.

This is a classic example of why you don't do EBay pre-sales. It takes nothing to throw up an auction for something you don't have (and have no guarantee of getting, unless you are a retailer). Most of those "pre-sales" are nothing more than someone that will run out and try and get one when it comes out - the exact same way you would. Then if something happens and they can't get it, they conjure up a story and back out and hope you don't complain. You aren't getting a guarantee with that premium you are paying, they are counting on your impatience to override your good sense. They aren't getting them faster than stores, or special shipments. Most of the time they are just ordering online from the same places you could order, for their cost - they just hope you don't know that.

And in this case, it is fairly clear he didn't get as many Quickdraws as he thought he won and he is trying to weasel out of it. It's not a scam in that he is trying to steal your money, but he did scam you on thinking he had an item incoming that he had no guarantee of getting. Now you have to track one down otherwise (or missed your opportunity to win one, if you stopped playing when you ordered). His cost? Nothing, but feedback. And he just pops up some more pre-sales up for stuff that isn't out yet.

It's simple, don't pre-order on EBay. You won't get it faster, and that peace of mind is an illusion. If Gamestop can't offer you a pre-order, then some dude on EBay isn't going to be a reliable venue for a pre-order. Because you know if Gamestop can pre-sell it, they for dang sure are going to do it.

Also, his scam didn't work because he was trying to offer you afterward a Regular Rattle Shake for in guessing the same price? But you didn't bite, so to save his good feedback he offered a refund.
