I do have kids and I do get it. But, his response was excessive based on the original post. It's only later that he added the stuff about the guy taunting him and approaching his car. If he lead with that, then he would have gotten more sympathy.

I'm not talking about the toys, I'm talking about heckling a small child. |

First off, we don't know what was said. TC didn't even say what was said that was "taunting". Second, the claims of taunting would be he-said, she-said (or he-said, he-said in this case). Giving someone a black eye leaves physical evidence behind and I'd be surprised if the incident wasn't caught on store security CCTV - which typically doesn't pick up video. Third, I don't think there are many states where "taunting" is a good legal defense against physically assaulting someone. And that's without knowing - at all - what kind of "taunting" was going on. "But your honor, he said 'I have this toy that you don't!' and was waving the toy around and everything!" That'll get you far. Quote: Tashiji

Wow, suggesting he needs therapy or jail time, then suggesting this is just over a toy. Way to completely gloss over the inconvenient details.
Had he beaten the guy to a pulp, sure. Had he hit the guy just walking by with them in his bag, sure. Being a parent involves more than just that. Sure, you don't teach them that violence can solve their issues. But, you also have to teach them that they need to stand up for themselves, and you are willing to stand up for them. A child that feels their parent will let people mock them and walk all over them in front of them with nary a reaction teaches them a far more damaging lesson than a simple pop in the smacker ever would. I don't expect people without children to understand this, nor some with them. And screenshotting it and reporting it just try and ensure something happens because of this? That's petty. The scalper probably slinked off realizing he got what he deserved. Had he showed a bit of decorum, he could have just silently walked off and collected his scalper bounty from eBay. He was the one that tried approaching a guy with his kid in the parking lot. That alone could be considered threatening behavior. Do you like having random strangers approaching you in the parking lot trying to score a quick buck? And that doesn't even begin to touch on solicitation laws that are set up to prevent exactly that sort of thing at places of established business. |

I've seen point #2. Obviously I disagree with it. Hence the reply. The legal system is clearly more subjective than you're giving it credit for being, especially if no arrests were made in the immediate aftermath of the incident. |

Wrong. You cannot set up shop in a store parking lot. Laws and TRU policies both exist that prevent this on their property, which it was. And likewise, he could very easily tell the officer this random guy came up to him and his small child with unknown motives and proceeded to try and scalp him merchandise from the store. A very strong self defense argument. |

Did someone say they were doing that? That's laughable. Quote:
The funny thing is, if the guy had approached him and offered to sell it for $16-$20, he likely would have been okay with it. I guess it's because I'm either older and wiser or young and naive, but I don't automatically feel threatened by other people walking up to me in a parking lot. |

I never really understood the whole "Oh you don't have kids you don't understand!". That's BS. When I do have a child they aren't going to be brought up to think it's okay to go around punching people just because they get called a name or don't get the toy they wanted. I never did it when I was a kid so why should my child? You can keep defending the OP all you want. But the fact is he is a sensitive bully and a criminal at this point for assualting someone for no legitimate reason. Was his son in danger? Did the scalper touch either of them? NO. OP never learned the whole sticks and stones thing and because of that he could have put his son at harm. What if the scalper had a gun? You know it's not really rocket science to get a gun permit these days. |

In *most* jurisdictions that I've dealt with, random guy on the street couldn't file that legal complaint - it'd be up to the owner (or lessee, in the case of some of these types of properties) to file the complaint. |

Yes, DutRank did, post #22. Fair enough, you don't. Things change when you have a small child with you. Things you would normally blow off turn into things you become intensely aware of when you are with your child. |

If no arrests were made, then the cops clearly weren't called. No way to be subjective when their not involved.

Subjective comes into play if the scalper decides to press a civil suit, which is still possible if he saw the OP's license plate or knows how to identify him. Obviously you can't go to a lawyer and say "I want to sue some guy" with no form of ID, but since it took place in a parking lot, there's always license plates.
