So I wake up early this morning, ready to make line at my local TRU (albeit 30 miles away) and my son becomes violently ill. Needless to say, that completely derailed my opportunity to leave early. Regardless, he's 4 years old and based on my prior success, I've promised him a Ninjini. Sick and all, he begs me to take him, so I figured fine we'll go. When we get there
the clerk tells us that we'e 5 minutes too late. They've sold out. I understand the whole concept of Skylanders on release date, so I tell my son that we'll have to come back another time. He was fine. That is until this guy, who I can only assume was a scalper, overhears me and starts trying to upsell me on his "3 extra figures he has". He said I could have one for $60.
Two things with this that just irked the **** out of me,
1) this TRU is notorious for limiting their quantity to 2 per customer, how did he score 4?
2) why would he think it would be cool to approach me and then have the nerve to tell my son "awe daddy doesn't want to buy it for you"
Needless to say, he may have left with a ninjini, but got a bonus black eye in the process.
scalpers = fail

Hate to admit it, but yes I did. I'm not condoning my behavior, especially in front of my son, but he had it coming. His obnoxiousness alone deserved it, let alone the fact that he started talking to my son about me, which any parent knows is immediately crossing the line.

My guess is that he had a buddy also in line get two additional ones with a possible "commission fee" for the trouble. Hopefully you didnt strike the tool despite I my agreeing with your statements. You could get in trouble with the law for a $15 toy and maybe not show your kid the best way to handle a situation. Sorry to critique or think I know better but I've been in your shoes and the hassle is not worth it.

I seriously doubt he will get $60 for it unless he gets lucky. The number of Ninjini auctions has skyrocketed in the past couple hours, to close to 300, and is still rising - with very few bids. I think people are probably learning their lesson from Thumpback/Eye Brawl, where they auctioned high only to become very, very common within a few weeks. I talked to a guy in line that was cursing himself for blowing $30 each for them, then he found them a couple days later. Sure, you might get lucky scalping one, but the days of stupidly high auctions on Ninjini ended this morning when TRU opened. The number of figures available went from 300 to 15-20 thousand almost instantly.

And you are right, it's just a game. But my reaction wasn't about the game, it was more about his behavior. I'll get Ninjini for my boy eventually, just didn't need some random a-hole pressing the issue. I guess the Brooklyn in me came out.

Saying that to your son was absolutely over the line. Not only is he taking advantage of children, but he is openly mocking your child. Violence is not a solution, but in this case I would have to admit I definitely support it. Children should be taught that there are better ways to handle situations, but they also need to know that their Dad is willing to stand up for them to people trying to take advantage of them. If someone said that to my son I would knock them into next week, then meet them there and knock them back to this week. This isn't about a $15 toy, it is about a grown adult taking humor in playing mind games with a child at the expense of their parent. |

I ran into a similar situation when Hot Head was impossible to find.... I got to a TRU on a Friday about 20ish minutes after they opened looking for Hot Head. I saw a person with four in her hand and asked if they had anymore. They did not. She then preceded to tell us that they would be on Ebay in 30 minutes for 35 dollars. The Manager told her that she could only buy 2 because two of us were looking for him and she had did the same thing the week before. She of course got upset but I applaud the TRU manager for doing what he did. That is why I will pay the extra dollar for characters if I find them their first instead of waiting.

I don't agree with you hitting the guy. You could have cursed him out and that would have got the point across well enough. What if the guy took it to the next level and starting fighting with you or, worse, pulled out a gun and shot you? And, all that would have happened with your 4-yr old standing there watching you.
You're feeling good because he didn't retaliate or it seemingly worked out in your favor. But, who knows, it may not be over. The guy could look to press charges or come after you in other ways. It seems far-fetched, but not impossible. That's probably why people are telling you to delete this thread. |

Lol, unlikely. The guy would have to really push it to do that. And then he would have to stand in front of a judge and explain that he got punched by a parent as he was mocking their child. Embarrassment tends to take over in those situations. And when it doesn't, judges really get upset at morons wasting their time. |

Well if the guy presses charges let him. Then you get a personal or class act suit going on acti for causing this kind of suituation to begin with. Plus with making over 500mil on the 1st game they can afford to give you a couple mil, lol. They caused these type of situation to happen by not allowing preorders, no single fig skus, or meeting initial supply to demand. All of which they have direct control over. So it was emotional distress brought on by a situation instigated by activison and there marketing and distributution process. To tell the truth Im very surprised this is the first incident (probly isnt though). Just look at all the black friday horror stories people hit and shot, over crap like $2 waffle irons.

Okay.... I don't really agree with hitting someone but...... it is easy for all of us who were not at the TRU in the heat of the moment to sit here at say.. It is not cool that you hit him. I mean was it a bad idea, probably. However, put yourself in the OP's shoes. You have a sick kid. Who wants Ninjini, and a guy with 4 of them offering to sell it to you for 60 dollars, basically mocking you and your kid. It would be a tough situation to be in. Also, cursing someone out basically does the same thing. If you say "I'm going to hurt you." (keeping it clean for the kiddies) can still get you thrown in the pokey.

LOL he couldnt press criminal charges, DUH! But he could sue them for distress due to a situation that was under there control, a good lawyer could easily win the case. The list of disgruntled people since adventure is long and the tension they cause is quite easy to see and hear when in line for these things. It is all activision responsibility and any lawyer worth 2 cents could easily prove it. Now would it be worth all the hassle who knows.

The people who are criticizing Daxious for punching the guy are either passivist tree-huggers, or don't have kids. The guy deserved a punch in the face for trying to belittle him in front of his child.
Daxious, you may not be proud of your actions, but my guess is that you just went up many notches in your son's eyes for standing up for yourself (and for him).

Just a note, things like posts on a forum aren't admissible in court. Second, punching someone in the face is assault. Unless the guy was threatening to harm your child, it doesn't matter if he was mocking your child, you would get charged with assault.

Straight sensitive bully? That's a new one. I said it before and I'll say it again. I'm not condoning my actions and I'm not ignorant to the consequences of my actions either, but as a parent there is a limit that I'm sure fellow parents all know. I didn't go into details in the original post, but I did try to ignore the ignorance as I always do. However, there is that fine line between being annoying and being aggressive and when I told the guy multiple times to walk away, when I start putting my boy in the car and he's peeking through the window and when my son starts to cry because this nut job decides to wave the figure at him in a taunting manner making him cry ... C'mon I'd love to see what everyone else would do in that situation.
What happened happened, can't change it now ... And quite honestly if approached with the same situation, I'd be BSing everyone to say I wouldn't probsbly handle it the same way. |

Besides, if the guy were to try to bring charges, he would have to explain why the altercation started in the first place, and at that point, his case starts to lose steam. And that's if the OP really punched the guy, which, due to the nature of the internet, is never a certainty. Personally, I'd have just keyed his car or popped a tire, but you've got to do what you've got to do to set a positive example, and I do applaud the OP for not wanting his son to grow up being trampled on by morons. Sometimes the right thing to do isn't always on the level legally, and eminent theory on moral development would back me up on that.

I'd just like to chuck this in here: preorders would not nessicarily solve anything. If Acti shared SKUs it certainly would help. BUT I've been to several EB Games stores around looking for some extra 'landers to customize- when I asked for my curiousity 4/6 told me that they got more preorders than stock. This was in Australia- I don't even want to imagine what it might do if they accepted preorders in America, a place much larger on Skylanders.
Anyway, which I can't say that I've been stopped by a scalper, I have to agree with everyone saying punching the guy was the wrong thing. Sticks hurt more than stones, IMO, pure violence is worse than charging ludicrously inflated costs for and then flaunting something in front of someone that you just shouldn't. Either way a Hunter needs to shoot this topic in the knees before everyone calls everyone even worse names. *stares at Hunters* |

OP admits that he let his frustration overrule his common sense. We wouldn't have heard about this story had the guy commenced to beating OP down for punching him or any other number of bad things had happened. We're only hearing about it because it had a "positive" outcome for the OP. Also, this is told from OP's point of view. What if the guy really directed the comment "Daddy won't buy it for you" to the OP? Would he still have been justified?
I understand that people can be jerks, but my first instinct when being mocked isn't to punch the person in the face. |

Post #34 is all the background you need. The scalper, i.e the bully, was stalking Dax and his son to their car, and taunting them as he followed them. Despite being told repeatedly to walk away and leave them alone, the bully did not, and he was rewarded with a punch in the face.
It's funny how desensitized to violence we are in movies, books, and TV, but how outraged some people get when someone gets put in their place for being a bully.
