It's not illegal for him to sell it. He as an individual would have no contract to not sell it before the street date. Assuming his story is legit and he was able to buy it from a store that store could get into trouble, even then it's not illegal, Activision does not have the authority to make laws. They would not be honoring their contract and there could however be fines which are no doubt listed in their contract.

In all honesty, this would actually be worth that price. Variant errors are almost nonexistent. They take the time to perfect all of them.
I've only seen 3 thus far; a Flocked S2 Stump Smash labeled as Stealth Elf, a Flocked Prism Break with an upside-down card, and a Flocked S1 Stump Smash rolling around in the package, off of the base.

I don't think that they did any extra care or diligence when making variants; it is merely that there are less of them, and hence less chance of a crappy one.

Misprints only have significance when it was an abherration of an automated process, not a manual one.

After all, otherwise people would be finding badly painted items and exclaiming that they are actually of higher value.

I could see that if they were selling the halves for like $10 each, so if you somehow lost a half it would be cheaper to get a replacement for that instead of paying for a whole new figure, but those prices are a joke.

Yes they know. They probably bought it in the store locally, and bought all they saw to try and create artificial rarity. Practically every Skylanders auction mentions "RARE" in it, regardless of the reality. They are hoping some parent is looking for it, doesn't see it in a couple stores then looks on EBay and assumes it is indeed rare. That's one of the things that gets me about scalpers, not every parent has the ability to know what is really hard to get or not, and to me it just seems scammy to do this to someone, hoping they fall for it.

And as far as the Chill above "missing lipstick", just LOL. Reminds me of the old lipstick color is a REAL VARIANT nonsense last year. Chill in particular has been incredibly inconsistent in quality this year. I've seen a TON of errors, including one that was completely missing an eye. It might have looked cool like she was winking, but they forgot the eyebrow too. I imagine some kid is going to end up with it, unfortunately, due to their parent not realizing the problem. I remember getting a Han Solo back in the day missing his gun and having a fairly poor paint job because my Mom didn't know any better and I think he was the only one they had. She totally made it up to me later when she found a Jawa (which was crazy rare back in the original twelve when they came out).

I have to say, in general, I'm pretty anal about paint jobs. When I have the opportunity, I will go through several to find the best one, and have seen many of poor quality over time. Jade Flashwing was the worst, I went through a good dozen or so on the pegs before picking one out.

Im rather picky about the paint jobs also defpally. I to do the same thing looking for the best painted ones.

I agree with you regarding the "Not easy" part, but what is this seller lying about? That it is Custom? That it is like the rare variant? That it is used? that it is starting at .99c instead of the normal $100+?

As long as they state what they are selling and not advertise it for what it is not. This seller has advertised this ad very well and if someone wants a clear green xxx with out the hefty price tag, I say go get it.

I was simply extending the conversation in a general aspect. That is why I tried to express that I have tried to report items *significantly* more dubious than these.

That said, custom or not, it is cashing in on the "frenzy" and I am sure some people will think it is kosher (heck, when I sold a SSA starter pack with a fig removed once, the buyer claimed I duped him because I said like new, even though I had in a large size, bold font a description of the fig missing as well as a picture confirming this). Hence, it has a hint of dubiousness.
